No:246, Ormanada Sitesi, 34450 Sarıyer/İstanbul PHONE: +90 530 820 25 39 WEBSITE: https://market.gusinaistanbul.com/en E-MAIL: info@gusinaistanbul.com Hereinafter referred to as the “SELLER.” BUYER NAME/SURNAME OR TITLE: …… ADDRESS: …… PHONE: …… E-MAIL: …… Hereinafter referred to as the “BUYER.” ARTICLE 2 – SUBJECT OF THE AGREEMENT This agreement outlines the rights and obligations of the parties regarding the sale and delivery of the product(s) ordered electronically by the BUYER from the SELLER’s websitehttps://market.gusinaistanbul.com/tr uct(s) possess the qualities specified in the agreement and are sold at the price stated in the agreement. This agreement is drafted in accordance with the provisions of the Law No. 4077 on the Protection of Consumers and the Regulation on Distance Contracts. The BUYER declares that they have been informed electronically about all preliminary information, including the main characteristics, sales price, payment methods, delivery terms, and the right of withdrawal for the product(s) before placing the order. The preliminary information provided on the payment page and the invoice are integral parts of this agreement. ARTICLE 3 – DATE OF THE AGREEMENT This agreement, prepared in two copies, was signed and accepted by the BUYER on the date …… after being signed by the SELLER beforehand. A copy of the agreement will be sent to the BUYER’s e-mail address. ARTICLE 4 – DELIVERY OF GOODS/SERVICES, PLACE OF FULFILLMENT, AND METHOD OF DELIVERY The goods/services will be delivered to the …… address requested by the BUYER and to the person/institution named …… for delivery. ARTICLE 5 – DELIVERY COSTS AND PERFORMANCE The delivery costs shall be borne by the BUYER. However, if the SELLER has stated on their website that delivery costs will be covered for purchases exceeding a certain amount, then the delivery costs shall be borne by the SELLER. Delivery will be made as soon as possible after stock availability and after the product cost has been deposited into the SELLER’s account. The SELLER must deliver the goods/services within 30 (thirty) days of the order and reserves the right to extend the delivery period by 10 (ten) additional days with written notice. If the product cost is not paid or is canceled in bank records for any reason, the SELLER is deemed free of the obligation to deliver the goods/services. ARTICLE 6 – BUYER’S DECLARATIONS AND UNDERTAKINGS The BUYER is responsible for inspecting the goods/services for any damages, such as dents, breaks, or torn packaging, before accepting delivery. Damaged or defective goods/services will not be accepted from the delivery company. Once the goods/services are received, they are deemed to be intact and undamaged. After delivery, the BUYER is responsible for taking care of the goods/services. If the BUYER’s credit card is used fraudulently by unauthorized individuals without the BUYER’s fault and the respective bank or financial institution does not pay the SELLER, the BUYER is obligated to return the goods/services to the SELLER within 3 (three) days. The delivery costs in this case will be borne by the BUYER. ARTICLE 7 – SELLER’S DECLARATIONS AND UNDERTAKINGS The SELLER is responsible for delivering the goods/services in sound, complete condition, in compliance with the specifications specified in the order, and accompanied by warranty certificates and user manuals, if applicable. If the goods/services are to be delivered to a person/institution other than the BUYER, the SELLER is not responsible for the recipient’s refusal to accept the delivery. After receiving a notice of withdrawal, the SELLER shall refund the goods/services price to the BUYER within 7 (seven) days and take back the goods/services within 20 (twenty) days. For valid reasons, the SELLER may deliver goods/services of equal quality and price to the BUYER before the fulfillment period expires. If fulfilling the order becomes impossible, the SELLER shall notify the BUYER before the fulfillment period expires and refund the amount paid within 10 (ten) days. Damaged or defective goods/services with a warranty can be sent to the SELLER for necessary repairs under the warranty terms. The delivery costs in such cases will be borne by the SELLER. ARTICLE 8 – SPECIFICATIONS OF THE GOODS/SERVICES The type, quantity, brand/model, color, and all-inclusive sales price of the goods/services are as specified on the product/service page on the website https://market.gusinaistanbul.com/tr and in the invoice, which is an integral part of this agreement. ARTICLE 9 – CASH PRICE OF THE GOODS/SERVICES The cash price of the goods/services is included in the sample invoice sent by e-mail after the order and the invoice accompanying the product. ARTICLE 10 – INSTALMENT PRICE The installment price of the goods/services is included in the sample invoice sent by e-mail after the order and the invoice accompanying the product. ARTICLE 11 – DOWN PAYMENT AMOUNT The down payment amount is included in the sample invoice sent by e-mail after the order and the invoice accompanying the product. ARTICLE 12 – PAYMENT PLAN If the BUYER makes a purchase with a credit card and in installments, the installment option selected on the website shall apply. The provisions of the agreement between the BUYER and the card-issuing bank shall apply. The BUYER is responsible for following the installment schedule and payments as specified in the bank’s account summary. ARTICLE 13 – RIGHT OF WITHDRAWAL The BUYER has the right to withdraw from the agreement within 7 (seven) days of receiving the goods/services. To exercise the right of withdrawal, the BUYER must notify the SELLER via fax, e-mail, or phone within the specified period. The goods/services must remain unused and undamaged during the withdrawal period. The original invoice and shipping receipt must be included. The SELLER will refund the BUYER within 10 (ten) days of receiving the withdrawal notice and will collect the goods/services within 20 (twenty) days. Delivery costs for the return will be borne by the SELLER. ARTICLE 14 – GOODS/SERVICES EXCLUDED FROM THE RIGHT OF WITHDRAWAL The right of withdrawal cannot be exercised for goods/services that cannot be returned due to their nature, those that perish quickly or expire, or single-use goods. The right of withdrawal is also not applicable for opened, damaged, or used items, including software, DVDs, CDs, and cosmetics. ARTICLE 15 – DEFAULT AND LEGAL CONSEQUENCES In the event of default on payments made by credit card, the BUYER is subject to the provisions of the agreement with their bank regarding interest and penalties. The SELLER has the right to claim damages and costs incurred due to the BUYER’s delay in fulfilling payment obligations. ARTICLE 16 – COMPETENT COURT Consumer Arbitration Committees and Consumer Courts at the SELLER’s location are authorized to resolve disputes arising from this agreement.
